BizSavy provides AI-powered business automation, chatbots, voice AI, and marketing systems through SaaS and API integrations.
We utilize third-party technologies such as Go High Level, OpenAI, BuildMyAgent.io, Stripe, Cloudflare, Make, and Skool to deliver customized AI and automation services.
3. Eligibility
Our Services are intended primarily for business clients (B2B).
There is no minimum age requirement, but users must have legal authority to enter into binding business agreements on behalf of their organization or themselves.
4. Account Registration
Users may need to create an account to access certain features. You agree to:
Provide accurate and current information during registration
Keep your login credentials secure and confidential
Notify us immediately if you suspect unauthorized access to your account
BizSavy is not responsible for unauthorized access resulting from your failure to maintain account security.
5. Payment Terms
Fees: Services are billed as monthly subscriptions, client percentage fees, and/or one-time setup fees, depending on your chosen plan.
Billing: Payments are processed via third-party providers such as Stripe.
Trials: We may offer free trials for limited periods. Continued use after the trial converts automatically into a paid subscription unless cancelled before the trial ends.
Refunds: We do not offer refunds after service activation.
Late or Failed Payments: BizSavy reserves the right to suspend or terminate access if payments are overdue or declined.
6. User Responsibilities
You agree to use our Services only for lawful, ethical, and business-related purposes.
You must not:
Use the Services for illegal, harmful, or fraudulent activities
Infringe on any intellectual property rights of others
Attempt to hack, reverse engineer, or disrupt the Service
Upload or transmit malware or unauthorized content
Resell or redistribute BizSavy’s systems or AI tools without written consent
You are responsible for reviewing all AI-generated content for accuracy, compliance, and appropriateness before use or publication.
7. Company Rights
BizSavy reserves the right to:
Modify, update, or discontinue any part of the Services
Change pricing with reasonable notice
Suspend or terminate accounts for non-payment, misuse, or violation of these Terms
Refuse service at its discretion, particularly to users engaging in prohibited or abusive behavior
8. Intellectual Property
BizSavy IP:
All platform software, AI systems, algorithms, designs, trademarks, and content created by BizSavy remain the exclusive property of BizSavy.com.
You are granted a limited, non-exclusive, non-transferable license to use our Services as intended.
Client IP:
You retain full ownership of:
Any content, data, or materials you input or upload into the Services
Any AI-generated outputs produced for your business
You grant BizSavy a limited license to process, store, and display this data solely to provide and improve the Services.
Training and Improvement:
BizSavy may use aggregated and anonymized data for internal analytics or service improvements but will never share or sell identifiable client data.
9. AI Usage Disclaimer
BizSavy’s AI systems generate content automatically based on user inputs and data sources.
While we strive for accuracy, AI-generated outputs may contain errors, biases, or incomplete information.
You acknowledge that:
AI outputs are for informational and operational support only, not professional or legal advice.
You are solely responsible for reviewing and approving any AI-generated materials prior to use.
BizSavy is not liable for any outcomes, damages, or losses resulting from reliance on AI outputs.
10. Fair Use and API Limits
To ensure stability and fair access:
BizSavy may limit API calls, automation volumes, or bandwidth for excessive or abusive usage.
Automated scraping, excessive requests, or misuse of integrations is prohibited.
Breaches of fair use may result in service throttling or suspension.
11. Data Privacy
Our handling of personal and business data is governed by our Privacy Policy, which forms part of these Terms.
By using our Services, you consent to BizSavy’s data practices as outlined in that policy.
12. Service Availability
BizSavy aims to provide reliable and continuous access, but we do not guarantee uninterrupted operation.
Temporary outages may occur due to maintenance, third-party issues, or unforeseen technical problems.
We will use reasonable efforts to notify clients of any significant disruptions.
13. Termination
We may suspend or terminate your access immediately if:
You breach these Terms
You fail to pay applicable fees
You misuse the Service or violate laws
You request account deletion
Upon termination, your right to use the Services ceases immediately, but ownership of your client content remains with you.
14. Limitation of Liability
To the maximum extent permitted by law:
BizSavy is not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill.
Our total liability for any claim related to the Services shall not exceed the amount you paid to BizSavy in the preceding 3 months.
BizSavy is not responsible for third-party integrations or their reliability.
Some jurisdictions do not allow certain exclusions; in such cases, our liability will be limited to the extent permitted by law.
15. Indemnification
You agree to indemnify and hold harmless BizSavy, its directors, employees, and affiliates from any claims, damages, or expenses arising from:
Your misuse of the Services
Your breach of these Terms
Your reliance on AI-generated outputs
16. Confidential Arbitration
Any dispute or claim arising from these Terms or your use of the Services shall be resolved by confidential binding arbitration conducted in Victoria, Australia, in English, before a single arbitrator.
Each party shall bear its own legal fees unless otherwise ordered.
Arbitration shall be final and binding, and judgments may be entered in any competent court.
17. Governing Law
These Terms are governed by and construed under the laws of Victoria, Australia, without regard to its conflict of law principles.
18. Changes to These Terms
BizSavy may modify these Terms at any time.
We will notify users of material changes by posting the updated version with a revised “Last Updated” date.
Continued use of our Services after changes constitutes acceptance of the new Terms.
